Membership Benefits
WC&C members are united in finding ways to advance the wall and ceiling industry as they improve our opportunities for success. Membership offers collective bargaining power for key issues in our industry, networking opportunities, legislative advocacy and professional development programs, in addition to mediation and arbitration of jurisdictional disputes.
Strong Relationships
Membership in the WC&C provides contractors and associations with a strong professional network and participation in the larger unionized construction industry through memberships in the BTEA, the STA and the NYBC.
Workforce Development, Networking, Advocacy and Labor-Management Support
WC&C members are automatically members of AWCI, whose members include large general contractors and construction managers. Association members can participate in networking, advocacy and workforce development opportunities provided by AWCI as well as by the Construction Industry Partnership, New York’s leading labor-management organization.
ANTITRUST FULL POLICY STATEMENT
Whereas it is the intent of the Association of Wall, Ceiling & Carpentry Industries of New York, Inc. ("WCC") as a trade association and members to operate and conduct business in a manner consistent with both the spirit and the letter of the antitrust laws, the WCC Board of Directors hereby adopts the following policy statement: The antitrust laws prohibit any agreement between two or more companies that results in an unreasonable restraint of trade. There is no safe harbor under the antitrust laws for trade association activities. Dealings among competitors that violate the federal antitrust laws still violate the law if done through trade associations. Violating these laws can result in criminal and civil penalties and reputational damage.
Included in activities and conduct that are forbidden under the antitrust laws are the following:
• Agreeing to fix or regulate prices, bids, margins or the conditions or terms of sale.
• Agreeing to participate in any form of complimentary, cover or convenience bidding.
• Agreeing to establish geographic trading areas, to allocate markets or customers, or not to bid on or pursue particular business or customers.
• Agreeing upon standardization of terms, such as credit, delivery costs, discounts or. promotions.
• Participating in any plan designed to control the means of transportation or channels through which product and supplies may be sold.
• Participating in any plan with others not to do business with particular parties or to exclude particular parties from the market. (Competitors may-entirely on their own choose with whom they will deal, but they should not discuss or agree with other competitors not to do business with particular suppliers, customers or other parties.)
This is, at best, only a general outline of some of the areas that pose antitrust dangers and that should be avoided during discussion at WCC meetings and events. Pricing and profit information and your intention to bid or pursue (or not bid or not pursue) particular business opportunities, or to enter or not enter a particular product or geographic market should not be discussed or exchanged among competitors. Each employee, officer, director, committee member and member of the WCC, if he or she is in any doubt whether a particular act or discussion may violate the spirit or any requirement of the antitrust laws, should seek immediate guidance and advice from WCC's General Counsel and/or the legal counsel of their own member company.
